Construction law. Mr. West represents construction owners, contractors, design professionals, and other industry participants on public and private construction projects typically involving infrastructure, transportation, commercial, industrial, and residential works throughout the Continental US and Alaska. In these engagements, Mr. West supplies practical, cost-effective advice to guide his clients through the complicated legal and regulatory environment in which they operate and in every phase of the construction process, including –crafting the inter-party contracting structure, developing financial and risk management strategies, securing required entitlements, drafting/negotiating trade contracts and other construction-related agreements, and directly assisting in the management of the project work to assure legal compliance.
A particular focus of Mr. West’s practice has been the implementation and oversight of unified project administrative systems during construction by internal client project teams, at both the corporate and specific “job site” level. Mr. West effectively assists in managing the planning, control, and coordination of work to achieve the functional and financial objectives of the client.
Construction disputes. Mr. West uses these management strategies to anticipate and prevent disputes that can threaten a project’s overall success and the client’s important relationships with other project stakeholders. But where disputes do arise, Mr. West successfully prosecutes contractor (General and Sub) claims for additional compensation and extensions of time, including claims for delays, disruptions, acceleration, scope changes, differing site conditions, work suspensions, and other performance-related matters. In multiple instances, Mr. West has represented demands for tens of millions of dollars on behalf of some of the largest developers and general contractors in the country.
Commercial real estate development. Mr. West’s legal practice also covers the expert handling of multiple aspects of commercial real estate law and development, including the acquisition and disposition of commercial properties, securing project entitlements, development entity formation, site planning and development, project financing, leasing, and environmental issues.
General Counsel and Chief Legal Officer. Mr. West has a unique perspective on the needs and objectives of private corporations because of his first-hand experience representing their interests. Earlier in his career, Mr. West served as Associate General Counsel for what was at the time the World’s largest mechanical/electrical contracting firm with $3.5B in annual revenue. Mr. West has also provided other senior legal officer services to a number of private start-up companies, counseling those businesses as general counsel and Chief Legal Officer on a full range of corporate legal issues including entity formation, corporate governance, the drafting, negotiation, and fulfillment of transactional agreements and other commercial contracts, the leveraging of intellectual property assets, and corporate strategy development and implementation. These “in house” experiences give Mr. West a unique perspective of the “consumer side” of the representation process.
Publications and presentations. Mr. West has published several articles and book chapters on topics relating to construction risks and other construction management issues and has contributed to Federal Publications and Wiley Construction Law Updates. He frequently appears at public presentations on various construction law topics to industry trade groups as well as conducts on-site seminars for client executives and staff.
