We Are Skilled Attorneys Ready To Represent You In Birth Injury Cases

Pregnant mothers entrust their and their babies’ well-being to qualified obstetricians with the expectation that they will receive state-of-the-art, up-to-standards care.

When an OB-GYN, a hospital or a birthing center fails to exercise proper caution during prenatal care, labor or delivery, and a mother or baby is harmed, the victims are entitled to seek compensation. Birth injuries resulting from medical malpractice or any type of negligence are responsible for lifelong handicaps for many children.

Contact Gammon & Grange, P.C., in northern Virginia to schedule a free initial consultation to discuss any birth injury that your child suffered resulting in lasting harm.

Obstetrics may not be an exact science, since every mother, every baby and every birth is different. However, the sum total of years of experience has given doctors a clear framework to work from to prevent birth injuries, including the following:

  • Cerebral palsy resulting from hypoxia (lack of oxygen to the brain of a baby during labor and delivery).
  • Shoulder dystocia resulting from failure of OB-GYNs to use proper rescue maneuvers when a baby becomes lodged in the birth canal during delivery.
  • Disabilities or still birth resulting from TTTS (twin-to-twin transfusion syndrome) affecting “identical twin or higher multiple pregnancies where two or more fetuses share a chorion and hence a single placenta, but have separate amniotic sacs. Severe TTTS has a 60-100 percent mortality rate” (description from Wikipedia). When interconnected twins share one placenta, one of them may become a blood donor to the other one, with the result that the donor has insufficient resources to thrive.
  • Failure to monitor fetal condition to determine if a baby is in distress.

Proper prenatal care is key to preventing many birth injuries such as TTTS, cerebral palsy and shoulder dystocia. An OB-GYN should monitor a pregnancy for risk factors and test accordingly. In the case of twins, an early ultrasound followed by proper treatment (such as in utero laser surgery) can prevent injury or death. An early ultrasound test for twins is known to be a valuable preventive measure.
