What Is The Virginia Birth-Related Neurological Injury Compensation Program?
The Virginia Birth-Related Neurological Injury Compensation Program provides an alternative to filing a medical malpractice claim against your doctor or hospital. The program is administered by the Virginia Workers’ Compensation Commission.
Benefits of the program include compensation for medical expenses, rehabilitation, residential and custodial care, lost earnings from ages 18 to 65, special equipment or facilities, medically necessary travel, and reasonable claim filing costs including attorney’s fees.
To be eligible, your child must have suffered a birth-related neurological injury such as cerebral palsy or hypoxia as a result of oxygen deprivation or mechanical injury. A participating doctor or hospital must have delivered your child. All petitions for entry into the program must be filed prior to your child’s 10th birthday.
